According to the regulations of the Federal Motor Carrier Safety Administration (FMCSA), all CDL drivers operating vehicles with a gross weight of 26,001 pounds or higher are required to enroll in a drug and alcohol consortium (C/TPA). Additionally, drivers operating buses with a capacity of 16 passengers or more must also register with a drug and alcohol consortium (C/TPA). These requirements are outlined in CFR PART 382.107 & 49 and CFR PART 40.

All employers and owner-operators falling under the Federal Motor Carrier Safety Administration (FMCSA) drug & alcohol testing program, who either employ a CDL driver or themselves operate commercial motor vehicles (CMVs) on public roads, are legally mandated to register with the FMCSA Drug and Alcohol Clearinghouse (DACH). This Clearinghouse serves as a secure online repository, providing real-time information to employers, the FMCSA, State Driver Licensing Agencies (SDLAs), and State law enforcement personnel regarding violations related to drug and alcohol programs of commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders.
